In a filing today in the Ohio recount case in federal court in Columbus, Ohio, the Ohio Attorney General and Ohio Secretary of State asked a federal judge to allow them to take depositions of Senator John Kerry and former Senator John Edwards. Ohio Attorney General Jim Petro and Ohio Secretary of State J. Kenneth Blackwell urge the court to dismiss `Kerry-Edwards` as an intervening party in the recount case. They argue that they should have the right to place Kerry and Edwards under oath for questioning on the grounds that the 2004 presidential and `vice-presidential` candidates should no longer be allowed involvement in the case.



What is behind this court filing? `Kerry-Edwards` 2004 submitted key filings in this case last week which supported claims made by 2004 presidential candidates David Cobb and Michael Badnarik that the Ohio recount was not conducted in accordance with uniform standards, as is required by the equal protection and due process guarantees of the US Constitution. These claims have been pending before Federal District Court Judge Edmund Sargus in Columbus since December 30, 2004. Cobb and Badnarik, who are represented by the National Voting Rights Institute, have also recently filed a motion for a hearing on the pending matters before the court, which `Kerry-Edwards` supported in its papers submitted last week.

Ohio Attorney General Petro and Secretary of State Blackwell are now clearly trying to remove `Kerry-Edwards` from this case either via a court order or, if that fails, via the threat of taking the depositions of Kerry and Edwards. On December 3, against Petro and Blackwell’s objections, Judge Sargus allowed the `Kerry-Edwards`’ motion to intervene in this case. Since that date, neither Petro nor Blackwell has sought to remove `Kerry-Edwards` from this case. Their effort to do so now should be rejected by the court and Kerry and Edwards should show that they refuse to be intimidated by these threats.

This is nothing more than an attempt to warn any who might have questions regarding election fairness and accuracy. Our rights to the court system are under assault....we are setting up a system in which only those holding political power have any rights at all.

I do wonder what's up with this. It will be interesting to see if either Kerry or Edwards agrees to the deposition. I think they should bring along Barbara Boxer if they do - and ask `C-Span` to televise it LIVE! laugh.gif

I don't think I've ever heard a better idea! I'd pay to watch that one.

This from the man who said he would NEVER under ANY CIRCUMSTANCES answer a subpoena to appear in court. Apparently J. Kenneth Blackwell is above the law, but the legitimately elected President and Vice President of the United States (who were robbed of their office) are not.

It must be a desperate effort to remove Kerry and Edwards from the picture. Isn't it true that if they aren't part of the case, there is no case ?
The other people on the ballot are not likely to be winners in the case of a recount . I know there is a stipulation regarding that, but I don't remember what it is.
Everything Blackwell does from this point on has to do with him wanting to be Governor.

Well, it should be interesting, as both Petro and Blackwell are running for governor in 2006...looks like they're having a p***ing match. Gotta really keep those rural right wingers wound up and spitting over democrats besmirching their honor.

For you people with kids you should recognize this ploy. My oldest son when I caught him lying or he did something wrong, he would try to say but so and so did this and that. Trying to convince me that what he did wasn't as bad as what someone else did. Blackwell is just trying to take the focus off him and slow the wheels of justice down. Those papers Kerry/Edwards just filed must have Blackwell scared cause he sure did shoot back fast.
Someone want to see if they can find what Kerry/Edwards filed and post them here :?: I'd love to see what Blackwell's wetting his pants over. laugh.gif

Blackwell reminds me of a `one-lipped` man in a `butt-kissing` contest. :twisted: :twisted: :twisted: If this were the WWE, Vince McMahon would be selling tickets at the door, thousands of dollars worth of merchandise, and offering this grudge match on `pay-per`-view. And Kerry, in the role of The Undertaker, would perfectly complement Edwards' Shawn Michaels against Petro and Blackwell, who, in this case, would be the Dudleys. *you wrestling fans in the house know who I'm talking about*

Sure 'nuff. The survey results of election workers that they filed were pretty damning. It was clear that the procedures weren't followed in many areas.

Thanks Sirius, don't know how I missed it. Interesting how the no's and yes's were almost equal, meaning only half the recounts were done correctly. I think Kerry was wrong not to fight from the beginning. I would not have cared if it looked like a `re-run` of Gore 2000. I think JRE wanted to fight but....Kerry probably said let it go. I've always wondered what JRE really thought about the whole thing.

Well, if you read the transcript of his interview with George Stephanopoulos the other week (or saw it), George asked him some question about why they lost and JRE said something about "outside influences" that sounded an awful lot like he knew there was at least a possibility the election was stolen, but was unwilling to say it. I can understand that. At this point anyone who doesn't already know it was stolen would interpret a blunt comment about it as whining.
